What's in Kentucky Divorce Index Files
Information in a Kentucky divorce index file normally includes the names of the husband and wife, their ages and residences, place and date of the divorce. It is important to understand that there occur numerous misspellings of names and many long given names are abbreviated or truncated. The wife's surname is usually, but not always, but very often the wife's surname is her maiden name. Some records may be missing, while others are duplicated.
Before you start your search, make sure you have the correct name of your subject - that's what many amateur online investigators and divorce records retrievers forget. Next thing to determine is the State or area where the divorce occurred. Also important is the type of final decree.
Illinois
The Illinois Department of Public Health (IDPH), Division of Vital Records does not issue certified copies of divorce records. Certified copies are available from the circuit court clerk in the county where the divorce was granted. IDPH, Division of Vital Records allow verifycation of the facts of a divorce that has taken place from 1962 through the current index date. Divorce indexes can only be searched by the husband's last name.
Public Access Opinions
"I think that more people are becoming aware that divorce records are public records. And people are much more sensitive to wanting more records sealed," said divorce attorney Sharyn Sooho, founder of DivorceNet, the divorce consulting web site operating over 10 years on the Internet. "Public is best served with open divorce records, not closed ones".
Programs
Arizona State University researchers launched their New Beginnings Program (NBP) in 1992. Based on years of university research, this parent education program teaches positive parenting skills to help sustain healthy family relationships. Using records of divorce cases provided by the Superior Court, ASU invited hundreds of families to participate in their program and found that children with parents in the NBP developed fewer psychological problems compared to their control group.
State Divorce Laws Provisions
Virginia
GROUNDS FOR ABSOLUTE DIVORCE.
(a) living separate and apart without cohabitation for one year; or (b) living separate and apart without cohabitation for six months if there are no minor children and the spouses have entered into a separation agreement; (c) adultery (including homosexual acts); (d) conviction of a felony and imprisonment for one year; (e) cruelty, one year of the act complained of; and (f) willful desertion or abandonment continuing for one year. Code of Virginia; Title 20, Section 20-91.
GROUNDS FOR LIMITED DIVORCE.
The grounds for limited divorce are: (a) cruelty; (b) willful desertion or abandonment; and (c) reasonable apprehension of bodily injury. Code of Virginia; Title 20, Section 20-95.
UNCONTESTED DIVORCE.
Written separation agreements are specifically authorized by statute. A party may waive service of process, but the waiver of service of process form must be signed in front of the clerk of the court or a notary. The testimony of either spouse must be corroborated by a witness. Code of Virginia; Title 20, Sections 20-99(1), 20-99.1:1, and 20-109.1.
